1. USER INFORMATION

Who is responsible for processing your personal data?

ECOPE INFORMATICA S.L. is the DATA CONTROLLER (hereinafter, the CONTROLLER) responsible for processing the USER’s personal data and informs you that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

For the purposes of this Privacy Policy, the term “USER” shall be understood as referring to any identified or identifiable natural person (“data subject”) whose personal data are processed.

For what purposes do we process your personal data?

Personal data will be processed for the following specific purposes:

  • Sending commercial and promotional communications by email, SMS or other electronic means, provided that the USER has given prior consent or where legally permitted in accordance with Article 21 of the LSSI-CE. These communications will relate exclusively to products and services of the CONTROLLER. Third parties will not have access to personal data for their own purposes.

  • Carrying out internal market research and statistical analysis aimed at improving services.

  • Processing orders, requests, responding to enquiries or any type of request made by the USER through the contact methods made available on the CONTROLLER’s website.

  • Sending newsletters about news, offers and promotions related to our activity, subject to prior consent where required.

What is the legal basis for processing your personal data?

Processing is legitimised under Article 6 of the GDPR as follows:

  • With the USER’s consent [Article 6.1(a) GDPR]: sending commercial communications and newsletters.

  • For the performance of a contract or pre-contractual measures [Article 6.1(b) GDPR]: processing orders, requests or enquiries made by the USER.

  • Based on the legitimate interest of the CONTROLLER [Article 6.1(bf) GDPR]: carrying out market research, statistical analysis, and processing orders, requests and enquiries made by the USER.

How long will we keep your personal data?

Personal data will be retained no longer than necessary to fulfil the purpose of processing or as required by applicable legal obligations. Data may be retained thereafter for the periods required to comply with legal obligations. Once no longer necessary, data will be securely deleted or anonymised.

To whom do we disclose your personal data?

Personal data will not be disclosed to third parties for independent commercial purposes.

However, data may be processed by service providers acting as data processors on behalf of the CONTROLLER (e.g., hosting providers, IT service providers, communication platforms), with whom the corresponding data processing agreements have been signed in accordance with Article 28 GDPR.

Where such providers are located outside the European Economic Area, international data transfers will be carried out in accordance with applicable data protection legislation and appropriate safeguards.

What are your rights?

The USER has the right to:

  • Withdraw consent at any time.

  • Access, rectify, port and erase their data

  • Request restriction of processing or object to its processing.

  • Lodge a complaint with the supervisory authority (www.aepd.es) if they believe that processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or in download forms, USERS expressly, freely and unequivocally accept that their data is necessary to process their request by the service provider. The USER guarantees that the personal data provided to the CONTROLLER is accurate and undertakes to notify any changes.

If all required data is not provided, it cannot be guaranteed that the information and services offered will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with current regulations on personal data protection, the CONTROLLER complies with all provisions of the GDPR and the LOPDGDD regarding the processing of personal data under its responsibility. 

In particular, data is processed lawfully, fairly and transparently in relation to the data subject, and is adequate, relevant and limited to what is necessary for the purposes for which it is processed, as set out in Article 5 GDPR.

The CONTROLLER has implemented technical and organisational policies to ensure a level of security appropriate to the risk, in accordance with Article 32 GDPR and the applicable provisions of Organic Law 3/2018 (LOPDGDD), in order to protect the rights and freedoms of USERS, and that USERS have been provided with the necessary information to exercise those rights.
